General Terms and Conditions (AGB) – SUNANDBASS Online Shop

1. Scope and Contract Language

These Terms and Conditions (AGB) apply to all orders placed in our online shop by consumers (§ 13 BGB – German Civil Code).

For customers residing in the European Union (EU), statutory consumer rights apply, including the right of withdrawal according to EU law.

Contract languages: German or English.

This is a courtesy translation. The legally binding version is the German version. In case of discrepancies, the German version shall prevail.

2. Conclusion of Contract

2.1. The presentation of products in our online shop does not constitute a legally binding offer, but an invitation to place an order.
2.2. A binding contract is only concluded when we confirm the order within one day via order confirmation or dispatch the goods.
2.3. The order process consists of:

Selecting products
Entering customer details (billing and shipping address)
Choosing a payment method
Reviewing all details and submitting the order

2.4. We only sell goods in standard household quantities.
2.5. Orders from persons under 18 years of age will not be accepted.
2.6. We use Shopify as our e-commerce platform. More details are provided in our

2.6.1. Order processing and payment transactions are handled via Shopify Payments and PayPal.
2.6.2. Customers can choose between Shopify Payments (credit card, digital payment methods) and PayPal as their payment option.
2.6.3. During checkout, customers may use the shipping and payment details stored with Shopify or PayPal.
2.6.4. Shopify provides information on how your payment data is processed.
2.6.5. Further details are provided during the checkout process.
2.7. If SUNANDBASS GmbH determines during order processing that the ordered products are unavailable, the customer will be notified by email. No contract will be concluded for unavailable items.

3. Right of Withdrawal and Returns

3.1.  Right of Withdrawal for Customers residing in the EU and other countries where a right of withdrawal is mandatory have 14 days from the date of receiving the goods to withdraw from the contract.
3.1.1. To withdraw from the contract, customers must notify us in writing via email or letter at:

3.1.2. A withdrawal form is available at:

3.1.3.Consequences of Withdrawal: We will refund all payments, including standard shipping costs, within 14 days after receiving the returned goods.
3.1.4. Refunds will be processed via the original payment method.
3.1.5. Return shipping costs must be covered by the customer, except in cases of defective goods.
3.1.6. Exclusions from Withdrawal:
The right of withdrawal does not apply to:

- Custom-made or personalized products.
- Sealed products (e.g., hygiene items, software, CDs) if the seal has been removed.
- Digital products
- Concert tickets. (Please note: SUNANDBASS Concert tickets have different T&C)

3.2. Voluntary Return Option for Non-EU Customers:

Customers outside the EU may return items within 14 days at their own expense.
Returns must be pre-approved via email at shop@sunandbass.net.

4. Shipping and Delivery

Shipping Methods

Orders are processed through AA Merch srls using DHL, UPS, FedEx, or other carriers.

Estimated Delivery Times

Italy and EU: 5–7 business days
United Kingdom: 7–10 business days (Express: 2–5 business days)
Worldwide (outside EU and UK): 7–15 business days

Important Notes:

Delivery times are estimates and may vary due to customs processing, local couriers, or unforeseen delays.
Customers outside the EU are responsible for any customs duties and import taxes.
Tracking details will be sent via email after dispatch.

5. Prices and Payment Methods

All prices include VAT (where applicable).
Accepted payment methods:
PayPal
Shopify Payments (Credit Cards, Digital Wallets)
Customers are responsible for any additional customs duties or local taxes for international orders.

6. Retention of Title

Goods remain the property of SUNANDBASS GmbH until full payment is received.

7. Warranty and Liability

7.1. Warranty Rights
7.1.1. Customers have statutory warranty rights under §§ 437 ff. BGB.
7.1.2. In case of defective goods, customers may request repair or replacement.
7.1.3. If repair is unreasonably costly, SUNANDBASS GmbH may offer a replacement.
7.1.4. Warranty period: 2 years from receipt of goods.

7.2. Liability Limitations
No liability for indirect or consequential damages from product use.
No liability for delays caused by third parties (e.g., shipping providers, customs).
Liability is excluded in cases of force majeure (events beyond our control).

8. Data Protection

We process personal data in accordance with GDPR regulations.

9. Online Dispute Resolution and Consumer Rights

The EU Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.
SUNANDBASS GmbH does not participate in consumer arbitration proceedings.

10. Governing Law and Final Provisions

German law applies.
The legal choice applies only if it does not override mandatory consumer protection rights in the customer's country of residence.

§ X Special Conditions for Certain Product Categories

a. Sale of Alcoholic Beverages (Wine)
We sell alcoholic beverages (wine) only to customers who have reached the legal minimum age in their country of residence.
By placing an order, the customer confirms that they are legally allowed to purchase alcohol.
We reserve the right to request age verification and refuse delivery if legal requirements are not met.
Customers are responsible for ensuring that alcohol import laws allow shipment to their country.
b. Digital Goods (e.g., Music Downloads, Livestreams)
Digital goods are delivered electronically only.
By completing the purchase, customers expressly agree that the download or streaming will begin immediately and thereby waive their right of withdrawal.
Customers are responsible for ensuring that their devices and internet connection meet the technical requirements for accessing the content.
c. Limited Edition Drops & Merchandise
Our merchandise items (e.g., t-shirts) are sold in limited quantities and may not be restocked.
Items in the shopping cart are not reserved until payment is completed.
To ensure a fair purchasing process, we reserve the right to cancel orders that exceed the purchase limit or indicate resale activity (e.g., bulk purchases).
